The 2026 Maryland legislative session is coming to a close on Monday, April 13, and we have one final choice to protect our neighbors and stop Maryland's role in mass deportations. Every day that we choose to help Immigration and Customs Enforcement (ICE), we fail our most vulnerable communities. Local counties are voluntarily funneling immigrant neighbors into ICE custody through informal back channels. The Community Trust Act (SB 791) closes those loopholes and stops local officers from voluntarily facilitating ICE arrests, keeping immigrant families together.

Currently, the law defines children as individuals under the age of 18. Yet in Maryland, children as young as 14 can be automatically charged as adults for certain offenses, and 16 and 17 year olds are automatically charged as adults for 33 different criminal offenses. Children charged as adults – even if their case is eventually transferred down to juvenile court – spend months and sometimes years in the adult legal system awaiting their court date.

There is no law in Maryland that specifically addresses racial discrimination in local elections. As related federal protections are under attack, SB 255 and HB 350 protects Black, Brown and other communities of color from being silenced in the electoral process. It establishes a clear, accessible legal pathway to challenge vote dilution in local county and municipal elections, so that everyone can have a fair chance to elect their preferred candidates whenever they go to vote.

Racial profiling violates the Fourth and Fourteenth Amendments and undermines public safety and community trust in Maryland. Maryland must take affirmative action to ensure existing protections against racial profiling are not eroded and to protect Marylanders from racial profiling and other abuses by federal agents to the maximum extent allowable by law. The US Supreme Court's continued dismantling of bedrock constitutional rights demands that the General Assembly take swift action to codify essential protections against racial profiling in our state law (SB 854/HB 1262). HB 1262/SB 854 had great hearings in the House and Senate, respectively. Now, we must urge Committee members to place the bill on a vote list and vote “Yes” on a clean bill with no amendments that weaken the bill.

Maryland currently enables President Trump's cruel and lawless mass deportation agenda by allowing localities to voluntarily funnel immigrants into ICE custody. Outside of 287(g) agreements that formally deputize local law enforcement as ICE agents, this informal collaboration has funneled 4 times more Marylanders – most of whom had no criminal conviction into the deportation pipeline. Shockingly, 23 of 24 Maryland counties informally assist ICE in this way. The Community Trust Act would affirmatively ban this practice, ceasing Maryland's complicity in the Trump administration's inhumane mass deportation agenda.
